Products / Services

1.(a) Your purchases will be deemed to have taken place in Ireland. These Terms and Conditions are constructed in accordance with Irish Law and the parties agree to submit to the exclusive jurisdiction of the Irish courts.

1.(b) Products/Services available on GraveCare website (may change from time to time) are available in Galway, Ireland

1.(c) Flowers/Planters delivered by GraveCare may be in bud form ensuring extended life of the product.

1.(d) Some of the services/products sold by GraveCare may be deemed harmful or poisonous. Please do not hesitate to contact us for further information regarding this matter. Contact details listed under section 6

1.(e) Products or parts to carry out maintenance are subject to availability, if supply difficulties occur we reserve the right to substitute a product/ service part of equal value and quality without notice.

1.(f) If GraveCare is not able to supply the product/service or an equivalent substitute product/ service we will notify you as soon as is reasonably possible and shall reimburse your payment in full or no later than 31 days after the intended delivery date.

1.(g) GraveCare accept no liability for loss or damage to your property while work is being completed between scheduled maintenances and after the contract has been fulfilled.

1.(h) GraveCare will not accept responsibility for issues arising from the provision of a service where relatable authorizations has not been acquired.

1.(i) Work is carried out on graves from Monday – Friday, work carried out outside these days may be subject to additional charges at the discretion of GraveCare. While every effort will be made to complete the work for special occasions GraveCare cannot be held responsible for circumstances beyond their control.



2.(a) Prices are inclusive of VAT

2.(b) The prices for the products/services we provide are valid for a fourteen day period after you have submitted your order.


Order /Payments

3.(a) In order to place your order you will be required to provide GraveCare with your personal details necessary for payment of a service or product. We accept payment by most credit / debit cards. Clicking on the complete your order on the website you are consenting to be bound by GraveCare Terms and Conditions  contained in these Terms and Conditions anywhere on the GraveCare Online Site.

3(b) Submitting your order form is subject to our acceptance of this order and we don’t consider ourselves bound by a contract with you unless we have issued you with a confirmation of order by email. This is not the email sent on submission of an order.

3(c) GraveCare does not accept order forms from customers under the age of eighteen (18) years.



4(a) Our deliveries only covers Galway area – Ireland.

4(b) When we accept your order form we will advise you by email of our intended delivery date. Order forms received on Sundays or Public Holidays will be processed the next working day. No deliveries take place on Sundays or Public Holidays. In this event we will contact you the next working day regarding you order.

4(c) Anomalies submitted in your personal details supplied may result in product/services not delivered on your requested date. To avoid delays please ensure you have entered the correct information for us to complete your order i.e. (1) Graveyard location (2) Directions to the grave (3)Details on the Headstone (4) Photo of Headstone (5) your Contact details.

4(d) Whilst every effort will be made by GraveCare to ensure deliveries of product/services will be carried out on the requested date, you acknowledge that on occasion circumstances beyond our control delivery of product/service on a requested date may not be possible. In such circumstances wherever possible GraveCare will give you notice and make an alternative arrangement or we will reimburse your payment in full.

4(e) Due to the nature of GraveCare business delivery of product/services cannot acquire a signature for the delivery of a product or carrying out a maintenance on a grave. Under these circumstances a digital photo will be taken as proof of (1) product delivered (2) maintenance work carried out on your behalf. We will email the photograph to your email supplied to us by you or an email address of your choice provided by you.

4.(f)On occasion GraveCare may email you about new services and dates of meaning to you. If you choose not to receive this material please let us know.



5(a) Orders may be cancelled up to 36 hours before the date you entered on the GraveCare website or specific orders given to us by you or a third party on your behalf by phone, text or email.

5(b) To cancel your order please contact us by email info@gravecare.ie, phone (please ensure you talk to a human, don’t leave a message or text us.

5(c) You are entitled to cancel any payment at any time when fraudulent use has been made on your credit/debit card by another person not acting on your behalf or as your agent and to be re-credited by GraveCare to the extent that such sums are not reimbursed by the card issuer in such circumstances.

7.(a) GraveCare will endeavour to ensure that the Online Site / Online Service it provides is working and error free. We cannot guarantee this and therefore GraveCare accepts no responsibility for any faults or interruptions of the Online Site / Online Services and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Online Site / Online Service impossible or impractical.

7(b) GraveCare does not accept any responsibility for any loss or damage due to the failure of its Online Site or its Online Service provided, delivering a product or carrying out a maintenance on a grave.

7 (c)1We accept liability for the death or personal injury arising from our negligence.

7 (d) 2 Subject to clause 7 (c )1 our liability in contract, tart (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order form with us shall be limited to a multiple of three times the price you have paid for the product/service.

7 (e) 3 Subject to clauses 7 (c )1 and 7 (c )2 above we exclude all liabilities for any claims, losses, demands and damages including without limitation, any cost, loss of data and any other consequential, incidental, special or punitive damages even if we have been advised of the possibility of such damages arising directly or indirectly out of or in any way connected with your use or inability to access the Online Site / Online Service whether arising in contract, tort (including negligence) under statute or otherwise Provided That nothing contained in these Term and Conditions affects or will affect you or the recipients statutory rights in relation to the quality, fitness or description of the Product / Service supplied.

7 (f) 4 Subject to clauses 1 (e ) and 4 (c ) above we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any causes whatsoever beyond our reasonable control.



8 (a) GraveCare reserves the right to supplement and amend the Terms and Conditions on which you are permitted to the Online Site or the Online Service from time to time. We will post any changes on the site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Online Site / Online Service. Changes will be effective five (a1) hours after the posting of any such change and all subsequent dealings between you and GraveCare shall be on the new Terms and Conditions.

8(b)Additionally we reserve the right to suspend, restrict or terminate access to the Online Site / Online Service for any reason at any time.


8(c)These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Online Site / Online Service provided that in the event of a conflict between any such other notices policies, disclaimers and other terms these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or enforceable  the remaining provisions shall remain in full force and effect.

8(d)GraveCare shall ensure it will comply with the current requirements of all current data protection legislation including without limitation the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time).we shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions as stated in our privacy policy.

8(d) A person who is not a party to the agreement between you and GraveCare has no right under the Contract (Rights of Third Patties)Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from the Act

8(e)Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understanding and agreement between you and GraveCare (whether written or oral) and sets forth the entire agreement and understanding between you and GraveCare relating to the subject matter hereof.
